Contractual Agreement
When you place your order and we have accepted it the contract between us is binding.
Ordering Process
i) You select the products(s) you wish to purchase and the quantity by clicking the 'Buy Now' button alongside the products(s) of interest. You may amend your selections on the Basket/Cart web page.
ii) To proceed with the transaction you select the 'Go to checkout' button on the Basket/Cart web page where you are invited to accept these terms before you click the 'Secure check out' button.
iii) The Secure Check Out is provided by third party providers called Santu and Globecharge. Here you enter your billing contact and delivery details.
iv) You then click the 'Next' button to review the details you entered.
v) Next click the button 'Buy Now'. You are transferred to the PayPal website where you pay for the products(s) via their secure payment process. All PayPal transactions are subject to the PayPal UK Ltd. Privacy Policy.
Note: Our email address sales@amodelrailway.uk is declared as our identity on the PayPal page.
vi) You receive an Order Acknowledgement email via Globecharge that shows details of your order.
vii) Up until the point you 'send your order' you can go back to amend your order or abort the purchase.
viii) You receive a transaction acknowledgement email from PayPal.
ix) You are returned by PayPal to our website where you are shown model kit build instructions that you can download to your computer.
x) We receive email notices from Globecharge and PayPal UK Ltd. of your order and payment.
Delivery
i) We shall review your order and payment and,
For .pdf Model Card Kits either:
a) Where you selected on your order 'I waive my right to cancel Model Kit(s)' we shall endeavour to email the kit(s) you ordered within 24 hours of your payment (not including weekends and UK public holidays) at which point the contract agreement becomes binding, or
b) Where you did NOT select 'I waive my right to cancel Model Kit(s)' we shall seek clarification from you and If you retain your rights we shall supply the model kit soon after the 14th day from the date of your payment at which point the contract agreement becomes binding, or
c) We shall advise by email reasons why we are unable to meet your order and in the event we are unable to fulfil your order or part of your order we shall refund your relevant payment via the PayPal service.
d) .pdf Model Card Kit(s) are delivered by email only to the registered PayPal email address shown in the transaction. In the event you do not receive the Kit(s) check that they were not blocked by your email system either because your mailbox was full, or had been incorrectly treated as Spam. You may contact us after 24 hours has passed to notify us of a non delivery.
e) Shipping only to UK, Canada, Australia and New Zealand.
For Material Kits either:
a) Arrange for delivery of the Material Kit(s) you ordered to the registered PayPal postal address shown in the transaction. Material Kits are dispatched by us via Royal Mail to UK destinations within 24 hours of your payment receipt (not including weekends and UK public holidays) or,
b) We shall advise by email reasons why we are unable to meet your order and in the event we are unable to fulfil your order or part of your order we shall refund your relevant payment via the PayPal service.

Prices
Product prices are shown on the website alongside the kits.
Postage prices, where applicable, are shown in pound sterling
For currency conversion use the 'Select Currency link' then click the 'Buy Now' button where the price is shown in your currency. This action does not commit you to purchase. Prices are indicative and may vary due to exchange rate fluctuations.
VAT is not charged.
Prices may change at any time but changes shall not apply to orders in progress at the time of a price change.
Digital Content
The .pdf Model Card Kits require Adobe Reader to open the file on a compatible computer, as specified by Adobe. Adobe Reader is available free of charge from https://get.adobe.com/uk/reader/. A colour printer (ink jet or laser) is required to print the .pdf data file.
Warranty & Defective Product
We do not warrant the model build quality since this is dictated by your own ability and attitude to assembling the kit as well as the suitability of printing equipment and materials you may choose to use.
For .pdf Model Card Kits
If the Kit .pdf data file:
i) will not open in Adobe Reader or,
ii) the file content appears corrupt or missing
then we shall endeavour to help you resolve the issue and if necessary email you a replacement .pdf kit data file.
For Material Kits
If the Material Kit does not correspond to the description shown on our website or is not of satisfactory quality please contact us to discuss the issue. You will be entitled to a refund of payments you made, including postage costs and, if required by us, reasonable costs incurred by you in returning product. Alternatively, we may agree to supply you replacement(s) or parts thereof as appropriate and we will pay postage costs to send you replacement(s).
Cancellation and Refund Policy
i) Your right to cancel .pdf Model Card Kit(s) is only applicable where you did NOT select on your order 'I waive my right to cancel Model Kit(s)' and you cancel within 14 days of order placement. Upon receipt of your request to cancel we shall acknowledge your request by email and refund payments via the PayPal service within 14 days.
ii) Where you purchased Material Kits and change your mind you may cancel at any time from receipt of our emailed order acknowledgement up until the 14th day after the products came into your physical possession. You shall return the Material Kit(s) at your expense. A full refund is dependent upon the condition of the returned product.
Cancellation Process
i) Either fill out and post/email our Cancellation Form, a web link to which is provided in our order acknowledgement or,
ii) You notify us by email your request to cancel, stating:
a) your name
b) your postal address
c) the date of your order
d) the products(s) ordered that you wish to cancel.
iii) In the event you sent an order cancellation that we did not receive you will need to supply us a copy of your original, dated cancellation before we refund.
Limitations of Liability
i) Neither party excludes or limits liability to the other in respect of death or personal injury caused by the negligence of the other.
ii) Neither party shall be liable to the other in any way whatsoever for indirect or consequential damages, loss of revenue, loss of profits, loss of goodwill, loss of anticipated savings and loss of, theft or damage to the other's records or data.
iii) In respect of all other costs, claims, expenses, loss and damage, the total aggregate liability of David Smith to the Customer under or in connection with the Agreement including, but not limited to in respect of breach of contract, misrepresentation or tort (including negligence) shall be limited to the price of the relevant product purchased.

All .pdf Model Card Kits and Fully Printed Material Kits are Copyright protected.
Kits supplied are for personal, non-commercial use.
Please do not supply your kit data file, prints or replicate models made from your kit to/for third parties.
If you wish to replicate a model as a gift for someone else please purchase another kit.
General Terms
Images of the kits and objects built from the kits shown on this website are for illustrative purposes only.
This Agreement shall be governed by and construed in accordance with English law and the parties here to agree to submit to the exclusive jurisdiction of the courts of England.
